Terms of service

Last updated October 19, 2026

Draft for legal review. This text has not yet been reviewed by an attorney and is not final.

These Terms of Service (“Terms”) are a binding agreement between you and AsktheX (“AsktheX,” “we,” “us”) governing your use of askthex.com, our apps and related services (the “Service”). Please read them carefully. Section 15 contains a binding arbitration agreement and class-action waiver that affect your legal rights. By creating an account, answering an invite, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility: adults only

You must be at least 18 years old, and of the age of majority where you live, to use the Service in any way, including to answer an invite. By using the Service you represent and warrant that you meet this requirement. We may ask for your date of birth and may suspend or delete any account we reasonably believe belongs to someone under 18. The Service is not directed to minors.

2. What AsktheX is, and what it is not

AsktheX is a neutral platform that lets an adult (“Profile Owner”) invite people they used to know (“Xs”) to share perspectives, and lets the Profile Owner decide what, if anything, is shown to others (“Viewers”). AsktheX does not write, verify the truth of, endorse or adopt any content users submit. Content reflects only the personal opinion of the person who wrote it. We are not a consumer reporting agency, and the Service must not be used as a factor in decisions about anyone’s eligibility for employment, credit, insurance, housing or any other purpose covered by the Fair Credit Reporting Act or similar laws.

3. Your account

You are responsible for all activity on your account and for keeping access to your email secure. Provide accurate information and keep it up to date. You may not create an account for someone else, impersonate anyone, or create a new account after we suspend you.

4. Your content and your responsibility

You are solely responsible for everything you submit, including answers, letters, replies, questions and photos (“Your Content”), and for the consequences of submitting it. You represent and warrant that Your Content (a) is truthful and based on your own first-hand experience; (b) does not violate any law or anyone’s rights, including privacy, publicity, defamation and intellectual property rights; (c) follows our Content Policy; and (d) that you have every right and consent needed to submit it, including for any person who appears in a photo.

5. License you grant

You keep ownership of Your Content. You grant AsktheX a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format (including into books and PDFs), display and transmit Your Content solely to operate, secure and improve the Service and as the Profile Owner chooses to share it. This license ends when Your Content is deleted from the Service, except for copies retained in backups, legal holds or our audit records as described in the Privacy Policy.

6. Consent controls

Responses are never published automatically. Profile Owners may approve, seal, reply to, report or delete any response about them, free of charge. We never charge anyone to seal, remove, report or delete content about themselves. Xs may decline any invite.

7. Prohibited conduct

8. Moderation and enforcement

We may, but are not obligated to, review, screen, remove or restrict any content, and suspend or terminate any account, at any time and for any reason, including suspected violations of these Terms, with or without notice. We may use automated tools to flag content. We record moderation actions in an audit log. Our decision not to act on content does not mean we approve of it.

9. Reporting, copyright and legal requests

Report content using the “Report” link in the Service. Copyright complaints under the Digital Millennium Copyright Act may be sent to our designated agent at legal@askthex.com, including the information required by 17 U.S.C. § 512(c)(3). We may terminate repeat infringers. We respond to valid legal process as described in the Privacy Policy.

10. Paid features

Some features may require payment. Prices, billing terms and refund rules are shown before purchase. Except where the law requires otherwise or the feature’s terms say so, payments are non-refundable. Payments never override any person’s privacy choices.

11. Assumption of risk

You understand that reading or sharing personal perspectives about yourself or others can be emotionally difficult and can affect your relationships, reputation and opportunities. You use the Service, invite others, answer invites, share links and rely on any content entirely at your own risk. You are solely responsible for your interactions with other users, on and off the Service. AsktheX does not conduct background checks and does not verify the identity, statements or intentions of users beyond the limited checks described in the Service.

12. Disclaimers

The Service and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability and security. AsktheX does not warrant that the Service will be uninterrupted, error-free or secure, or that any content is accurate, complete or reliable.

13. Limitation of liability

To the fullest extent permitted by law, AsktheX and its owners, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, reputation or emotional distress, arising from or related to the Service, any content, or any conduct of any user or third party, under any theory of liability, even if advised of the possibility. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) US $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

14. Indemnification

You will defend, indemnify and hold harmless AsktheX and its owners, officers, employees, contractors and agents from and against any claims, demands, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or related to (a) Your Content; (b) your use of the Service; (c) your violation of these Terms or any law; or (d) your violation of any rights of another person, including anyone you write about or share content with.

15. Dispute resolution: binding arbitration and class-action waiver

Informal resolution first. Before filing a claim, you agree to email legal@askthex.com describing the dispute and to try to resolve it informally for at least 60 days.

Arbitration. Except for small-claims cases and requests for injunctive relief to protect intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.

Class-action waiver. You and AsktheX each waive any right to a jury trial and agree that claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding.

Opt-out. You may opt out of this arbitration agreement by emailing legal@askthex.com within 30 days of first accepting these Terms, with your name, account email and a clear statement that you opt out.

16. Governing law and venue

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-laws rules. For any matter not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Texas.

17. Termination

You may stop using the Service and delete your account at any time in Settings. We may suspend or terminate your access at any time. Sections 4, 5 (for retained copies), 11–16 and 18 survive termination.

18. General

These Terms, the Privacy Policy and the Content Policy are the entire agreement between you and AsktheX about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. We may update these Terms; material changes take effect when posted with notice in the Service, and continued use means you accept them. Nothing in these Terms creates a partnership, agency or employment relationship.
